Diplo sued for allegedly filming sex act without plaintiff’s consent

A new lawsuit filed against Diplo alleges that he intimidated a woman into performing oral sex on him and recorded the encounter without her consent, according to legal documents obtained by TMZ. In the lawsuit, the woman claims that she and her friends attended Diplo’s afterparty at The Wynn following one of his Las Vegas shows in 2019. At the afterparty, Diplo is said to have provided alcohol and marijuana to the already intoxicated group, and later asked the plaintiff to accompany him in his private room at the hotel, at which point Diplo’s security began to remove people from the party. This included one of the woman’s male friends, who was reportedly punched in the face because he refused to leave without her.

In the documents, the woman states that Diplo barred her from leaving the private room until she performed oral sex on him. The producer, real name Thomas Wesley, also filmed the act without her consent, the lawsuit alleges. The woman has filed the lawsuit to seek damages, TMZ reported.

Diplo’s attorney Bryan Freedman refuted the claims made in the lawsuit, calling the complaint “completely outrageous”:

“This complaint is completely outrageous, wildly untrue and yet also entirely predictable, given that it simply repeats the exact same claim already made by the plaintiff’s friend Shelly Auguste, an individual who has been harassing Mr. Pentz and his family for more than a year and already has repeatedly violated the restraining order issued against her.

We have irrefutable evidence that this is a completely meritless claim and we will be providing it to a court as quickly as we possibly can to put an end to this shakedown by Ms. Auguste and her accomplices once and for all.”

Freedman is notable for representing Diplo in a 2020 sexual battery lawsuit filed by Shelly Auguste, who accused the DJ of harassing her with revenge porn derived from one of their sexual encounters, said to be filmed without Auguste’s knowledge or approval. At the time, Freedman asserted that Auguste’s claim was a part of an “ongoing campaign of harassment” targeting Diplo. Both Diplo and Auguste filed for restraining orders against each other.

The new allegations have since led The Baltimore Orioles to cancel Diplo’s July 24 postgame performance at Camden Yards.

This is a developing story; Dancing Astronaut will report details as they become available.
